§ 682 Emergency Contraception Fee Limits

Key Takeaways

  • •Doctors can prescribe emergency contraception (like the morning-after pill) over the phone or online.
  • •They can’t charge more than $10 for this service.
  • •This rule doesn’t stop doctors from making other deals with insurance companies for payment.

Example

A woman calls her doctor because she needs the morning-after pill. The doctor prescribes it over the phone.

The doctor can charge her up to $10 for this service, but not more. If the woman has insurance, the doctor can still work out a separate payment deal with the insurance company.

§ 682 Emergency Contraception Fee Limits

An individual authorized to prescribe emergency contraception who issues a prescription or order for emergency contraception drug therapy as a result of a patient contact by telephone or electronic means may not charge an administrative fee or fees totaling more than ten dollars ($10) for emergency contraception drug therapy services. This limitation is not intended to interfere with other contractually agreed-upon terms between an individual prescriber and a health care service plan, insurer, or disability insurer for payment directly to the prescriber by the plan or insurer. (Added by Stats. 2003, Ch. 652, Sec. 2. Effective January 1, 2004.)
