§ 5223 Commercial Industrial Unzoned Areas

Key Takeaways

  • •This law defines what an 'unzoned commercial or industrial area' is.
  • •It's an area that looks and acts like a business or factory zone, even if it's not officially zoned that way.
  • •It includes all the land where these activities happen, plus 1,000 feet around it.
  • •It doesn't count things like billboards or roadside fruit stands as commercial or industrial activities.

Example

A big factory is built in a rural area with no zoning laws.

Even though the area isn't officially zoned for factories, the land around it (up to 1,000 feet) is considered an 'unzoned industrial area' because it's used like one.

As used in this section, “commercial or industrial activities” does not include the outdoor advertising business or the business of wayside fresh product vending. (Added by Stats. 1970, Ch. 991.)
