§ 4876 Licensee Probation Authority

Key Takeaways

  • •The board can put a licensed person on probation instead of taking away their license or just fining them.
  • •While on probation, the person might have to take extra classes or training to prove they’re still good at their job.
  • •The board can make the person see a doctor for a check-up to make sure they’re okay to keep working.
  • •The board can also limit what kind of work the person can do while on probation.

Example

A doctor makes a few mistakes at work, but nothing super serious.

Instead of taking away the doctor’s license, the board puts them on probation. The doctor has to take extra training classes and can only see patients with another doctor watching for a while.

In addition to its authority to suspend or revoke a license or registration, or assess a fine on a person licensed or registered under this chapter, the board shall have the authority to place a licensee or registrant on probation. The authority of the board to discipline by placing the licensee or registrant on probation shall include, but is not limited to, the following: (a) Requiring the licensee or registrant to complete a course of study or service, or both, as prescribed by the board, and to demonstrate renewed competence to the satisfaction of the board. (b) Requiring the licensee or registrant to submit to a complete diagnostic examination by one or more physicians appointed by the board. If the board requires a licensee or registrant to submit to that examination, the board shall receive and consider any other report of a complete diagnostic examination given by one or more physicians of the licensee’s or registrant’s choice. (c) Restricting or limiting the extent, scope, or type of practice of the licensee or registrant. (Amended by Stats. 2009, Ch. 80, Sec. 13. (AB 107) Effective January 1, 2010.)
