§ 3096 Optometry Competency Examination Orders

Key Takeaways

  • •If an eye doctor makes a big mistake, like hurting someone badly or being really careless, they might have to take a test to prove they can still do their job safely.
  • •The test results can be used as proof in any future decisions about whether the doctor can keep working.
  • •The doctor’s test results will be looked at along with other important information before making a final decision.

Example

An eye doctor keeps giving patients the wrong glasses prescription, and some people get headaches or can't see well because of it.

If the doctor keeps making this mistake, the board might make them take a test to check if they’re still good at their job. If they fail or do poorly, it could be used as proof that they shouldn’t be allowed to keep working as an eye doctor.

(3) An act of incompetence or negligence causing death or serious bodily injury. (4) A pattern of substandard care. (b) The results of a competency examination shall be admissible as direct evidence and may be considered relevant in any subsequent disciplinary or interim proceeding against the licensee taking the examination, and, assuming those results are determined to be relevant, shall be considered together with other relevant evidence in making a final determination.
