§ 2220 Physician Discipline Enforcement

Key Takeaways

  • •The medical board can punish doctors who break the rules, even if they are retired or not currently working.
  • •The board must check complaints about doctors within 30 days to see if they need to stop the doctor from working right away.
  • •If a doctor has paid more than $30,000 total in lawsuits or settlements for mistakes, the board will investigate them.
  • •The board also looks into doctors who have many lawsuits or complaints about hurting patients.

Example

A doctor makes a mistake during surgery, and the patient sues. The doctor’s insurance pays $25,000 to settle the case. Later, another patient sues for a different mistake, and the insurance pays $10,000.

Because the total paid ($35,000) is more than $30,000, the medical board will investigate the doctor to see if they should be punished or stopped from practicing.
