§ 17919 Bankruptcy Fictitious Business Names

Key Takeaways

  • •If a business owner goes bankrupt, dies, or sells the business, someone else can file the business name papers later to fix mistakes.
  • •This helps the new person in charge (like a trustee or family member) get money the business is owed.
  • •The new papers must say who ran the business before and include a special sentence about this law.
  • •The person filing must sign, give their address, and say why they’re doing it (like ‘I’m the trustee’).

Example

A small bakery called ‘Sweet Treats’ was run by Jane. She passed away, and her son, Tom, took over but forgot to file the business name papers. Now, a customer owes the bakery $500 for a cake.

Tom can still file the business name papers later under this law. This way, he can sue the customer to get the $500 the bakery is owed, even though he didn’t file the papers on time.
